Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Quick Cal platform and services ("Service"), operated by Quick Cal ("we," "us," or "our"). By creating an account, claiming your website, or subscribing, you agree to be bound by these Terms.

1. The Service

Quick Cal provides a suite of tools for small businesses, including:

  • Website builder: We create and host professional websites for small businesses, including AI-generated content based on publicly available business information.
  • Custom domain registration: For subscribers, we register and manage a custom domain on your behalf.
  • AI voice agent: An AI-powered agent that handles inbound calls, collects job information, offers appointment slots, and sends automated notifications.
  • Scheduling and dispatch: Tools to manage leads, appointments, and customer communications.

The Service is intended for business use only. You must be at least 18 years old and have the authority to bind your business to these Terms to use the Service.

2. Prospecting Websites and the Claim Process

As part of our customer acquisition model, we proactively create preview websites for small businesses using publicly available information (business name, address, phone number, category, and Google reviews). These preview websites are unclaimed and are created to demonstrate the value of our Service.

What an unclaimed site is: A preview website that has been built for your business but not yet subscribed to. It is accessible via a temporary URL and is intended for demonstration purposes only.

Claiming your site: By entering your claim code and subscribing, you take ownership of the website and authorize us to publish it under your custom domain. You are responsible for reviewing all AI-generated content for accuracy and requesting any corrections.

Removal requests: If you are a business owner who does not wish to have a preview site created for your business, contact us at legal@quick-cal.com and we will remove it promptly.

Content accuracy: Website content is generated from publicly available data and may contain inaccuracies. You are responsible for reviewing your site content after claiming and notifying us of any corrections needed.

3. Account Registration

You must create an account to use the Service. You agree to provide accurate, complete information and to keep your account credentials secure. You are responsible for all activity that occurs under your account. Notify us immediately at legal@quick-cal.com if you suspect unauthorized access.

4. Subscription, Fees, and Domain Registration

Access to a live website with a custom domain requires a paid subscription at $99/month. Your subscription includes:

  • A professionally designed website hosted by Quick Cal
  • A custom domain registered and managed on your behalf
  • Ongoing hosting, maintenance, and support

Subscriptions are billed monthly or annually as selected at checkout. All fees are processed through Stripe. We reserve the right to modify pricing with 30 days' notice.

Domain ownership: The custom domain registered for you remains associated with your account while your subscription is active. If you cancel your subscription, your domain registration will lapse unless you request a transfer prior to cancellation. Contact us at legal@quick-cal.com to initiate a domain transfer.

Cancellation: You may cancel your subscription at any time. Your website and domain will remain active through the end of your current billing period. No partial refunds are issued.

Failure to pay may result in suspension of your website and loss of domain registration.

5. SMS Messaging and Telephone Communications

By using the Service, you authorize Quick Cal to send automated SMS messages on your behalf to:

  • Your customers and callers, using contact information they provide to your AI voice agent
  • You and your team members, for lead alerts and operational notifications

You are solely responsible for ensuring you have appropriate consent from your customers to receive SMS communications. You agree to comply with all applicable laws and regulations governing SMS and telephone communications, including the Telephone Consumer Protection Act (TCPA) and CAN-SPAM Act.

You agree not to use the Service to send unsolicited messages, spam, or communications that violate applicable law.

Message frequency varies based on appointment activity (typically 1–3 messages per appointment). Message and data rates may apply.

To opt out, reply STOP to any message. To get help, reply HELP or contact us at legal@quick-cal.com. You agree to honor all opt-out requests promptly.

6. AI Voice Agent

The Service includes an AI-powered voice agent that handles inbound calls to your business. You acknowledge that:

  • The AI agent will identify itself as an automated scheduling assistant when asked
  • Call transcripts and collected caller information will be stored in your account
  • You are responsible for complying with any applicable call recording and disclosure laws in your jurisdiction
  • The AI agent is designed for scheduling and intake purposes only and should not be used for medical, legal, financial, or emergency services

7. AI-Generated Website Content

Your website may contain content generated by artificial intelligence based on your publicly available business information, including your business description, services, and Google reviews. You acknowledge that:

  • AI-generated content may contain inaccuracies and should be reviewed by you after claiming
  • You are responsible for ensuring your website content is accurate and compliant with applicable laws
  • You may request content corrections at any time by contacting us at legal@quick-cal.com
  • We are not liable for any inaccuracies in AI-generated content

8. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of any applicable law or regulation
  • Impersonate any person or entity or misrepresent your affiliation
  • Use the Service to harass, abuse, or harm others
  • Interfere with or disrupt the integrity or performance of the Service
  • Attempt to gain unauthorized access to any part of the Service
  • Use the Service to send emergency communications — the AI agent is not a substitute for emergency services

9. Data and Privacy

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. You are responsible for the lawful collection and use of your customers' personal information through the Service.

You grant us a limited license to process data you and your callers provide solely to operate and improve the Service. We do not sell your data or your customers' data to third parties.

10. Intellectual Property

The Service and its original content, features, and functionality are owned by Quick Cal and protected by intellectual property laws. You retain ownership of any original content you submit to the Service. You grant us a limited license to use your content solely to provide the Service, including displaying it on your website and in associated marketing materials.

Websites created by Quick Cal using our templates and AI tools remain our intellectual property. Upon cancellation, you retain rights only to original content you provided; website design and structure remain ours.

11. Third-Party Services

The Service integrates with third-party services including:

  • Stripe — payment processing
  • Lob — physical mail and postcard delivery
  • Twilio — SMS messaging
  • Resend — email delivery
  • Retell AI — AI voice agent
  • Supabase — database infrastructure
  • Vercel — platform hosting

Your use of these integrations is subject to their respective terms of service. We are not responsible for the availability, accuracy, or conduct of third-party services.

12. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT ANY DEFECTS WILL BE CORRECTED.

THE AI VOICE AGENT AND AI-GENERATED WEBSITE CONTENT MAY CONTAIN ERRORS. YOU ARE RESPONSIBLE FOR REVIEWING ALL CONTENT AND COMMUNICATIONS GENERATED BY THE SERVICE.

13. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, QUICK CAL SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNTS PAID BY YOU TO US IN THE TWELVE MONTHS PRECEDING THE CLAIM.

14. Indemnification

You agree to indemnify and hold harmless Quick Cal and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising out of your use of the Service, your violation of these Terms, or your violation of any applicable law or third-party rights.

15. Termination

Either party may terminate the Service relationship at any time. We may suspend or terminate your account immediately for violation of these Terms. Upon termination, your website will be taken offline and your domain registration will lapse unless a transfer is arranged in advance. We may delete your account data in accordance with our data retention policy.

16. Governing Law

These Terms are governed by the laws of the State of Utah, without regard to conflict of law provisions. Any disputes arising under these Terms shall be resolved in the courts located in Utah County, Utah.

17. Changes to These Terms

We reserve the right to modify these Terms at any time. We will provide at least 14 days' notice of material changes by email or through the Service. Your continued use of the Service after the effective date constitutes acceptance of the updated Terms.
